Terms of service

The Japanese version of these Terms is the official version. The English, Chinese and Korean versions are reference translations.

Article 1 (Application)

These Terms apply to everyone (“you”) who uses the website and related services (the “Service”) operated by 日本ブギウギメディカル株式会社 (“we” or “us”).

Article 2 (Description of the Service)

  1. We operate the website of the Service, and sell and deliver medicines.
  2. Consultations and prescriptions of medicines are provided by doctors at our partner clinic.
  3. We deliver medicines only if a doctor approves the prescription.

Article 3 (Conditions of Use)

You must meet all of the following conditions.

  1. You are 18 years of age or older
  2. You can receive items at an address in Japan (your home, hotel, etc.)
  3. You report accurate information about your health in the health questionnaire and consultation
  4. You follow the doctor's instructions and the directions for use of the medicines

Article 4 (Orders and Formation of Contract)

  1. When you complete your order and payment, a contract is formed on the condition that a doctor prescribes the medicine.
  2. If the doctor determines that the medicine cannot be prescribed, the contract is canceled, and we will refund the full amount of your order.

Article 5 (Consultation)

  1. After ordering, you will submit an online health questionnaire. The doctor reviews the questionnaire and then holds the consultation.
  2. Consultations are provided by doctors at our partner clinic by video call or other means.
  3. You can receive the consultation in almost any language (English, Chinese (Simplified and Traditional), Korean, etc.).
  4. You can receive the consultation wherever you are staying. However, medicines can be received only in Japan.
  5. If you order the same medicine again within 12 months of your previous consultation, as a general rule we will ship it without a new consultation. If there is a change in your health, a consultation may be held.
  6. We and our partner clinic are not liable for any consequences arising because what you reported differs from the facts.

Article 6 (Payment)

  1. Payment is made by credit card in Japanese yen. Payments are processed through our payment processor (Stripe).
  2. For cards issued outside Japan, you are responsible for any currency conversion fees or other fees set by your card issuer.

Article 7 (Delivery)

We deliver only within Japan. Details are set out in the Shipping Policy.

Article 8 (Cancellations, Refunds, and Returns)

The conditions for cancellations, refunds, and returns are set out in the Refund and Cancellation Policy.

Article 9 (Taking Medicines Out of Japan)

  1. If you take prescribed medicines out of Japan or bring them into another country, it is your responsibility to check and comply with the laws and regulations of the countries concerned.
  2. We and our partner clinic do not guarantee that medicines can be brought into another country.
  3. On request, we will issue a doctor's certificate in English and your native language for the prescribed medicines, for a fee (3,000 yen, tax included).

Article 10 (Prohibited Acts)

You must not do any of the following.

  1. Reporting false information, or impersonating another person
  2. Transferring or reselling prescribed medicines to a third party
  3. Using the Service for wrongful purposes
  4. Infringing the rights or interests of us, our partner clinic, or any third party
  5. Interfering with the operation of the Service

Article 11 (Disclaimers)

  1. We and our partner clinic do not guarantee the effectiveness of the medicines.
  2. We are not liable for delays or non-delivery due to reasons not attributable to us, such as natural disasters, traffic conditions, or circumstances on the part of the delivery company.
  3. Except in cases of our intentional misconduct or gross negligence, our liability is limited to the amount you paid.

Article 12 (Personal Information)

We handle your personal information in accordance with the Privacy Policy.

Article 13 (Changes to These Terms)

We may change these Terms as necessary. The changed Terms take effect when they are posted on the Service.

Article 14 (Language)

The Japanese version of these Terms is the official version. If there is any difference between it and a translated version, the Japanese version prevails.

Article 15 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan. Any dispute relating to the Service is subject to the exclusive jurisdiction of the Osaka District Court as the agreed court of first instance.
